Limited Warranty and Safety Disclaimer

This Limited Warranty describes the warranty coverage provided by Wildfire Equipment for Water Winger products. It also explains important operating limitations and safety responsibilities. Please read this document and the applicable product instructions before installing, deploying, or operating any Water Winger equipment.
1. Five-year limited warranty
Wildfire Equipment warrants to the original purchaser that the Water Winger frame and rigging system will be free from defects in materials and workmanship for five years from the original retail purchase date.
Covered components include the Water Winger frame; frame hardware and attachment points; rigging and deployment ropes; rigging and storage bags; throwing balls; and the ball chucker.
This warranty applies to household, community, institutional, and professional use, provided the equipment is used, maintained, stored, and deployed for its intended purpose and in accordance with the applicable instructions.
2. Warranty remedy
If Wildfire Equipment confirms that a covered product or component has a defect in materials or workmanship during the warranty period, Wildfire Equipment will, at its option: repair the defective product or component; replace it with the same or a functionally equivalent product or component; or refund the original purchase price attributable to the defective product or component.
A repaired or replaced product or component is covered for the remainder of the original warranty period or any longer period required by applicable law. Replacement products and components may differ in colour, appearance, or minor design details when the original version is no longer available, provided the replacement is functionally equivalent.
3. Who is covered
This warranty applies to the original purchaser. It also applies to a person who received the product new as a gift from the original purchaser, provided acceptable proof of purchase is supplied. The warranty does not automatically transfer when a product is resold or acquired second-hand.
4. Proof of purchase
The warranty period begins on the original retail purchase date. Proof of purchase may include an invoice, sales receipt, order confirmation, Wildfire Equipment’s own order records, or other evidence reasonably acceptable to Wildfire Equipment. Product registration is not required.
5. What is not covered
This warranty covers defects in materials and workmanship. It does not cover damage or deterioration caused by ordinary wear that does not result from a manufacturing defect; misuse, neglect, accident, or improper deployment; failure to follow instructions; unauthorized modification or repair; abrasion, dragging, cutting, puncture, crushing, impact, or sharp objects; prolonged exposure to sunlight, weather, or moisture; unsuitable or damp storage; mould, mildew, corrosion, or odour caused by damp storage; freezing or failure to drain water-bearing components; operation outside specified pressure or flow limits; contaminated water or clogged components; direct flame, extreme radiant heat, or falling debris; interrupted or inadequate water, pressure, flow, fuel, or electrical supply; or another cause outside Wildfire Equipment’s reasonable control.
An exclusion applies only to the extent that the excluded condition caused or contributed to the claimed defect or damage.
Orange fabric, deployment ropes, bags, throwing balls, and similar materials may fade when exposed to sunlight. Fading or another cosmetic change that does not materially affect function is not, by itself, a defect in materials or workmanship.
6. Third-party products
The Water Winger five-year limited warranty does not apply to products manufactured by third parties unless Wildfire Equipment expressly states otherwise in writing. Third-party products may include sprinkler heads, pumps, hoses, valves, fittings, nozzles, and related accessories.
These products may be covered by warranties offered by their respective manufacturers. Wildfire Equipment will provide reasonable assistance in identifying the manufacturer and pursuing available manufacturer warranty coverage. Any description of a third-party warranty is provided for convenience and remains subject to that manufacturer’s terms.
Nothing in this section limits any rights or remedies the purchaser may have against Wildfire Equipment under applicable law.
7. Making a warranty claim
Contact Wildfire Equipment before returning or shipping any product. Provide your name and contact information; proof and date of purchase; the order or product number, if available; a description of the problem; and photographs or video showing the claimed defect.
Wildfire Equipment may assess a claim using photographs, video, a remote functional test, or an inspection. Only the affected product or component should be returned unless the complete system is requested. Do not ship equipment until return instructions have been provided.
If a return is required, Wildfire Equipment will provide shipping instructions. Wildfire Equipment will pay reasonable standard shipping costs for approved warranty claims within Canada. If inspection determines that the problem is not covered, Wildfire Equipment will explain the reason. No chargeable repair or chargeable return shipment will be undertaken without the customer’s prior approval.
8. Inspection, maintenance, and storage
Before each wildfire season and every deployment, inspect all system components; confirm that ropes and fabric are not cut, excessively worn, or damaged; assemble and flow-test the complete system; confirm available pressure and flow; verify that sprinkler heads rotate correctly; and repair or replace damaged components before deployment.
After deployment, confirm that the system is operating and providing the intended coverage. Pressure and flow at an elevated sprinkler may be lower than at the water source.
After use, drain all water and allow every component to dry completely. Store the system clean, dry, indoors, and protected from sunlight, freezing, chemicals, pests, and physical damage.
9. Important safety information
Water Winger equipment supplements – but does not replace – evacuation planning, evacuation orders, emergency instructions, FireSmart measures, professional firefighting and emergency services, adequate insurance, or other structure-protection measures.
Deploy the system well before hazardous wildfire conditions reach the area. Never delay evacuation to install, activate, inspect, adjust, repair, reposition, or retrieve equipment.
Always follow current product instructions, obey evacuation orders and government directions, assess overhead lines and other hazards, maintain a safe distance from electrical equipment, and leave immediately when conditions become unsafe.
Never enter or remain in a building threatened by fire. Never approach equipment when flame, heavy smoke, falling embers, radiant heat, falling debris, electrical hazards, or other unsafe conditions are present. Water Winger equipment is not personal protective equipment and is not designed to protect people or animals from wildfire.
10. Performance limitations
Wildfire behaviour and structure exposure are unpredictable. No rooftop sprinkler, ground sprinkler, water-delivery system, or other structure-protection device can guarantee that a building, its contents, surrounding property, or occupants will survive a wildfire.
Actual performance depends on deployment timing; correct installation, placement, and operation; inspection and maintenance; available water, pressure, and flow; pump operation and fuel or electrical supply; hose layout and elevation; nozzle condition; sprinkler rotation; wind; temperature; radiant heat; direct flame; ember load; roof design; nearby fuels; terrain; and operator decisions.
When properly selected, installed, supplied with water, activated, and operated, Water Winger equipment is designed to distribute water over portions of a roof and surrounding area. It is not designed to guarantee prevention of ignition or property loss, extinguish or control a wildfire, protect occupants, withstand direct flame or extreme radiant heat, or replace professional firefighting services.
Wildfire Equipment does not guarantee uninterrupted operation because water, pressure, flow, pumps, fuel, electricity, hoses, sprinkler heads, and other components may fail or become unavailable for reasons outside its control.
11. Limitation of liability
To the maximum extent permitted by applicable law, Wildfire Equipment will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from a breach of this Limited Warranty.
Nothing in this Limited Warranty excludes or limits rights or remedies that cannot lawfully be excluded or limited; liability for fraud or wilful misconduct; or liability for personal injury, death, or property damage to the extent that such liability cannot lawfully be excluded or limited.
No provision requires a purchaser to release or indemnify Wildfire Equipment for liability that Wildfire Equipment cannot lawfully exclude or transfer.
12. Statutory rights
This Limited Warranty provides specific contractual rights. Purchasers may also have rights and remedies under applicable federal, provincial, territorial, state, or other law. Those rights and remedies are not replaced, restricted, diminished, or waived by this Limited Warranty.
For consumer purchases in British Columbia, applicable rights may include statutory conditions relating to product description, fitness for purpose, merchantable quality, and reasonable durability.
Where a provision conflicts with a mandatory legal requirement, the mandatory requirement will apply and the remaining provisions will continue to operate to the extent permitted by law.
13. Governing law
Subject to any mandatory consumer-protection law that applies to the purchaser, this Limited Warranty is governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia. This choice does not deprive a purchaser of mandatory protections provided by the laws of the place where the purchaser resides.
